Paul Fuller is a barrister practising business, property and chancery law out of 42BR Barristers in London.  Before becoming a barrister, Paul was a litigation solicitor and head of dispute resolution at a law firm with offices across Kent.  During this masterclass Paul will be discussing two cases – one involving the supply of utilities to the business market, and the other involving a contract for the sale of property. The cases both proceeded to hearings where the courts had to decide whether to strike the defendants’ cases out and award the claimants summary judgment.  During the hearings, the courts had to grapple with various legal issues including alleged breach of statutory, contractual and tortious duties; the interpretation of contracts and the novel doctrine of “misnomer”; as well as the approach the courts take to applications like these.  Interestingly, the courts arrived at very different decisions in each case.  Paul will also be discussing the kinds of commercial and tactical considerations that come into play when assisting clients in matters such as these.
